摘要註:	隨著台灣迅速邁入高齡社會，長期照顧機構在提供老年照顧服務中扮演關鍵角色。然而，機構內管理不善與照護疏失等問題時有所聞，衍生多起違法案件，對住民安全與福祉造成嚴重影響，亦引發社會廣泛關注。本研究旨在分析台灣長照機構違法案件的成因，並提出改善建議。研究以2010至2023年間司法院公布之判決書為資料來源，透過關鍵字搜尋「長照機構」、「照服員」、「損害賠償」、「照顧疏失」、「醫療糾紛」、「過失致死」及「業務過失傷害」等詞彙，初步取得55件判決書，經過篩選與排除無關案件後，保留30件與照護行為直接相關的案件，並採用內容分析法進行系統性檢視。結果顯示，30件案件中民事與刑事案件各占一半，民事案由主要為損害賠償，刑事則多涉及過失傷害與過失致死。常見傷害類型包括擦傷、骨折、壓瘡、顱內出血與嗆咳（食）等，形成原因多與照服員疏忽、長者健康因素及少部分管理缺失有關。綜合分析後歸納出人為、管理與環境三大違法成因，並運用魚骨圖進行視覺化呈現。研究最後針對照服員專業培訓、機構內部管理與政府政策提出具體改善建議，強調應強化人力資源培育、提升專業素養與照護品質，以降低違法風險，確保住民安全。

However, incidents of poor internal management and care negligence have frequently led to legal violations, raising serious concerns regarding resident safety and institutional accountability. This study investigates the causes of legal violations in Taiwan's LTC institutions and proposes targeted improvement strategies. Judicial verdicts published by the Judicial Yuan from 2010 to 2023 served as the primary data source. Using keyword searches including "long-term care institution," "caregiver," "compensation," "negligence," "medical dispute," "negligent homicide," and "professional negligence," we initially retrieved 55 verdicts. After excluding irrelevant cases involving salary disputes, partnerships, or duplicates, 30 care-related cases were selected for analysis. Through content analysis, the study found that the sample was evenly divided between civil and criminal cases. Civil cases primarily involved compensation claims, while criminal cases related to negligent injury and negligent homicide, with outcomes ranging from acquittals to imprisonment. Common injuries included abrasions, fractures, pressure ulcers, aspiration (choking), intracranial hemorrhage, and cardiopulmonary failure. The root causes were mostly attributed to caregiver negligence, resident health conditions, and, to a lesser extent, institutional mismanagement. A fishbone diagram was used to categorize the contributing factors into human error, managerial deficiencies, and environmental conditions. Based on these findings, the study recommends strengthening professional training for caregivers, enhancing institutional management systems, and improving regulatory oversight to ensure care quality and reduce legal risks.
